As part of the Allen County Bar Association's (ACBA) two-day seminar in September, Dave Farnbauch will be presenting a talk on preparing a case for mediation. On September 6th, 2019, Indiana Trial Lawyer's Association will host a seminar entitled "A Day with Rick Friedman". The day-long seminar will cover the topics of Visual Persuasion at Trial, How to Talk to Juries About Non-Economic Damages, and more. Sweeney's Dave Farnbauch is serving as Program Chair. Rick Friedman Rick Friedman is one of the truly elite plaintiff lawyers in this country but his influence on our profession extends far beyond the record-breaking verdicts and settlements. His teachings have had a profound impact on the way we practice tort law and the manner in which we should conduct ourselves, both in and out of the courtroom. Rick began his career in a one lawyer office in Sitka, Alaska. Rick began winning difficult cases which prompted other lawyers to come to him for help in overcoming defense tactics that distort the truth. Eventually, this led to Rick authoring four best-selling and books for trial lawyers: Rules of the Road, Polarizing the Case, Becoming a Trial Lawyer, and the Elements of Trial. Rick has won numerous noteworthy verdicts that have made the world a safer and more just place including four verdicts that have been in the top ten verdicts in the U.S. in the year they were returned. He is a Past President of the Inner Circle of Advocates and was named Trial Lawyer of the Year in 2013 by the Washington State Association for Justice. In 2019, Rick was named Trial Lawyer of the Year by the Southern California Trial Lawyers Conference. Rick Friedman has been asked to speak at state and regional TLA’s all over the country and has tried his best to teach us there is no magic formula, no one-size fits all blueprint to become a successful trial lawyer. We must be willing to work hard and expose ourselves to risks and rejection. More importantly, we must be willing to look deeply into our own souls. Rick has also taught us we should learn from each other but not fall into the trap of comparing ourselves to other trial lawyers and their results. He is licensed to practice in Alaska, Washington and California and regularly appears pro hac vice in state and federal courts all over the country.

David Farnbauch will be presenting a talk about Alternatives to Special Needs Trusts on Thursday, May 9th at the 31st Lifetime Achievement Event. 13 veterans have filed a class-action complaint against VA Northern Indiana Health Care System. The veterans, who were victims of medical malpractice, were patients of Dr. Bradley Hammersley over a seven-year period. The complaint claims hospital staff knew of the botched surgeries. Even though letters were sent to over 100 veterans, most were outside the two-year statute of limitations. The 13 veterans filing the claim tell echoed stories of their experience with widespread malpractice as a result of surgeries by Dr. Hammersley. On August 16, 2018, David Farnbauch will serve on a panel with Will Ramsey and Mike Michmerhuizen (with the Barrett & McNagny Firm) for a panel discussion regarding the issue of when expert testimony is needed to preclude summary judgment based on a unanimous medical review panel decision. The August 16th continuing legal education program is sponsored by the Allen County Bar Association and will follow an oral argument before the Indiana Court of Appeals in Courtroom #1 the Allen County Courthouse. Event Details Court of Appeals of Indiana Oral Argument & Discussion Glon v. Memorial Hospital of South Bend. Inc, 18A-CT-00049Glon heard three pops in her leg after hospital staff moved her post-surgery. When the epidural wore off, x-rays revealed three fractures in her leg. Glon alleged she was injured as a result of negligent hospital care. The hospital filed a motion for summary judgment, arguing that Glon failed to offer expert testimony to contradict the medical review panel's conclusion that there was no negligence. The trial court granted this motion, and Glon now appeals - arguing that a jury should have determined when the three fractures occurred because it is a genuine issue of material fact. David Farnbauch will chair the Trojan Horse Method Seminar put on by the Indiana Trial Lawyer's Association in Indianapolis, IN on June 20th. What's this seminar about? Trojan Horse is a revolutionary trial skills program that trains you to win in the courtroom. You will learn how to develop the emotional core of your case, so the jury can experience your clients’ stories. We don’t just talk about how to present your case, we show you. The exceptional trial lawyer will have three things: presentation skills, emotional congruence and a trial structure. Trojan Horse teaches trial presentation skills combined with theory that works. Presentation skills cannot be learned in a book. Only skills that can be used in the courtroom are taught. It all begins with the Method. The Method is the only program that requires participants to stand up and present 3-4 times every session, that means 6-8 times a day, with immediate feedback. The Method pushes you hard, but you will develop the highest order of skills. We give examples of voir dire, opening, direct examination, cross examination and closing argument. Additionally, David Farnbauch has been asked to serve as chairman of the 53rd Annual Indiana Trial Lawyer’s Association “Annual Institute” seminar at the Indiana Convention Center in Indianapolis. The seminar will be held on November 7-8 and will feature legendary trial attorney Mark Mandell from Providence, Rhode Island.
